Man pleas innocent in gate attack

A man accused of injuring his fiancee with a baby gate, pleaded not guilty to a felony charge.

Brian A. Setzer appeared in the Third District Court of Judge Richard Lavery at an arraignment to aggravated assault and battery. If found guilty, he could face a maximum sentence of 10 years in prison and a maximum find of $10,000. A jury trial has been scheduled to take place April 13 at 9 a.m.

According to court documents, on Nov. 2, 2014, a Green River Police officer was called to the Memorial Hospital of Sweetwater County to check on a possible domestic violence case that had occurred in Green River.

Upon arrival, the officer was told by an emergency room nurse Jessica Marshall that Ashley Rillamas had been brought into the ER by Setzer after an alleged altercation. Marshall told the officer Rillamas had allegedly been struck in the face with a baby gate that had been thrown by her fiancee Setzer.

Marshall told the officer that Rillamas had significant injury to her left eye that may require her to have emergency surgery.

After a CT scan was performed, Rillamas had to be flown to Salt Lake City for emergency surgery.

The same officer then met with Rillamas at the hospital. The officer observed that Rillamas who was barely coherent and medicated, had sustained an injury to the her left eye, which was at that time completed swollen shut and had dark purple bruising around it.

Rillamas had a hard time talking to the officer due to the pain.

The officer then met with Setzer, who stated that he and his fiancee Rillamas had been in a relationship since 2007; and have had a son together. Setzer said that on Nov. 2, 2014, Rillamas was “goofing around” with him at first, but then the situation excavated when she started “pushing his buttons.”

Setzer told the officer that he suffers from obsession-compulsive disorder, which causes him to get angry easily; and that Rillamas knows how to “push his buttons” to anger him. He told the officer he put the baby gate up high so Rillamas could not climb over it. When Rillamas came up the stairs, Setzer allegedly kicked the baby gate, which broke and struck Rillamas in the face. Setzer admitted that he was angry when he did this, but as soon as he saw the extent of the injury to Rillamas’ face he took her to the hospital.
